										<content:encoded><![CDATA[<p>Employees and employers nationwide are wondering about tax on tips and tax on overtime after H.R.1, also known as The One Big Beautiful Bill Act, was enacted on July 4, 2025. This Act included several changes that will affect payroll for the year 2025 and forward. These <a title="two deductions" href="https://www.irs.gov/newsroom/one-big-beautiful-bill-act-tax-deductions-for-working-americans-and-seniors" target="_blank" rel="noopener"><span style="color: #00b0f0;"><u>two deductions</u></span></a> relating to tips and overtime are retroactive to January 1, 2025, meaning this Act encompasses all wages in these categories paid for 2025, not just after the passing of the Act.</p>
<h3><b>Will Tips be Taxed?</b></h3>
<p>The “No Tax on Tips” section of the Act provides a deduction for employees and self-employed individuals who receive tips. To qualify for the deduction, the tips wages must be reported on a W-2, 1099, or other statement specifying the amount received, and will be reported on Form 4137 when filing annual federal taxes.</p>
<p>If the employer, or self-employed person, is a Specified Service Trade or Business, they are not eligible for the deduction. Additionally, the IRS will be providing a list of qualifying occupations that receive tips, and those using the deduction will need to be engaged in an approved occupation. This list is due to be furnished by the IRS in October of 2025.</p>
<h3><b>Will Overtime be Taxed?</b></h3>
<p>Like tip income, the “No Tax on Overtime” portion of the Act provides a deduction for individuals who receive qualified overtime – this means the overtime pay is required by the Fair Labor Standards Act (FSLA) and must be reported on a W-2, 1099, or other specifying statement. Employers are required to furnish statements to the taxpayer (employee, for example), as well as the IRS.</p>
<p>In conclusion, while taxes will still be deducted throughout the year on tips and overtime, a deduction will be applied to an individual’s tax return at year-end for wages that qualify for the deduction. Qualified wages must be reported on a W-2, 1099, or other specified statement to be properly deducted.</p>
<p>These deductions do not reduce taxable income at the time the income is earned, so employees and employers must still continue to collect and remit applicable taxes on these wages.</p>

Knowing what you can and cannot deduct for travel on your business taxes is important in keeping tax records accurate and in line with IRS regulations. There are many misconceptions about how business travel deductions work and what is actually considered travel for business.</p>
<h3><b>What is business travel?</b></h3>
<p>When trying to determine whether travel expenses are indeed related to business travel, the first thing to consider is your “tax home,” a term the IRS uses to help qualify how business travel is defined.</p>
<p>Per the IRS, <a href="https://www.irs.gov/publications/p463"><span style="color: #007bb8;"><u>your tax home</u></span></a> is the entire city or general area where your main place of business is located. Where you live does not affect what your tax home is when qualifying business expenses.</p>
<p>If you work in more than one place, it will be the main location where your business is located. While there are multiple factors the IRS considers when determining a tax home, the most important is the length of time spent at a location for business purposes.</p>
<p>If you are traveling away from your tax home for a period of time that is longer than a standard workday and you need sleep or rest in order to complete your work tasks, the expenses incurred during that travel may be deductible.</p>
<p>Deduction rates are related to the expense type. Meals, for example, generally have a 50% deduction rate. Entertainment, on the other hand, gets no deduction.</p>
<p>When considering expenses for business travel, keep in mind that the purposes of the travel and the expenses must be related to business, and the individual claiming the deductions must be able to show that a real business purpose exists for the expense.</p>

If you are $4,000 short of your budgeted income, you know you will not be able to do your $1,000 bonuses in May.</p>

<p class="yiv9512602087MsoNormal">For example, what if you had a fraudulent charge on your account in August, but you did not notice until you reconcile in December? This makes it much more difficult to prove it was fraudulent and report that it was fraudulent.</p>

<p>The first quarter of every year brings a bevy of due dates to a business owner, including one of the most important but overlooked annual filings, the Annual Report. Generally filed with the Secretary of State, this filing is what allows an entity to legally conduct business in a state as a corporation, LLC, partnership, or non-profit. Annual Report filings are not part of federal tax filings or state tax filings and is separate from any business licenses applied for.</p>
<p>Its purpose is to provide the state and the public with information pertaining to the entity, like ownership structure and business activities, as well as how to communicate with them in regard to its business dealings in the state. If there is a board, the report provides details as to who those members are and in what capacity they serve the organization. Additionally, this filing provides information on a Registered Agent – a person or company that is authorized to receive legal and government communications on behalf of a business.</p>
<p>Requirements vary by state and entity structure, as do deadlines and fees associated with filing.</p>
<h3><b>What happens if I don’t file an Annual Report?</b></h3>
<p>One of the most basic tenets of the Annual Report is that it allows an entity to legally conduct business in the state of filing. If this filing is not completed by the state’s deadline, the entity will be dissolved and will no longer be able to legally conduct business.</p>
<p>Legal standing in the state you operate in can affect your ability to bid jobs, obtain financing, and maintain good standing with the state. While it is possible to reinstate an entity once dissolved, there will be additional fees or penalties associated with reinstatement. Reinstatement may require additional documentation from other agencies and can take time to process.</p>
